Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The situation originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face human smuggling charges, he was detained in immigration detention.
In her order, the judge noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
